The Great British Bake Off Application Website Terms and Conditions

These terms and conditions (“Terms and Conditions”) govern the use of the Love Productions' website at https://gbbo.take-part.co.uk/ (the “Application Website”) in connection with applications for The Great British Bake Off (the “Programme”). 

In these Terms and Conditions “we/us/our/Love” refers to Love Productions Limited whose registered address is at Grant Way, Isleworth, Middlesex TW7 5QD and its assignees, licensees and affiliates and, where appropriate, to any subcontractor engaged by Love to build and/or provide services for the Application Website and its contents. “You/ your” refers to applicants for the Programme and users of the Application Website. 

Access to and use of the Application Website is provided subject to the conditions set out below and your use of the Application Website implies full acceptance of these Terms and Conditions. These Terms and Conditions should be read in conjunction with the Take Part Privacy Policy, the Take Part Cookies Policy and the Rules of Entry for the Programme (“Rules of Entry”) which form part of these Terms and Conditions.

We reserve the right to modify, update or otherwise change these Terms and Conditions (or any part of them) at any time without prior notice. Any changes will be posted on the Application Website. You will be deemed to have accepted variations and changes to these Terms and Conditions unless you have requested that your application be deleted from the Application Website or (if you have applied by post), you have requested that  your application is deleted or destroyed. You are advised to check these Terms and Conditions regularly. 

1. Disclaimer

1.1 We are not responsible for any Application Website or platform you link to from the Application Website.

1.2 Submitting an application, and/or registering and submitting personal details, to the Application Website does not give you any legal rights or impose any obligation on us to cast you as a contributor to any of our programmes or to produce or transmit such programmes. Any decisions regarding successful applications will be made in our sole discretion.

1.3 Due to the large number of applications and registrations we receive, you accept that we will not acknowledge or respond to each and every submitted application made on the Application Website.

1.4 Whilst we have taken reasonable care to ensure that the information placed on the Application Website by us is accurate, the Application Website has been created on an “as is” basis and Love does not make any representations or warranties as to the accuracy or completeness of the Application Website, nor do we warrant that the Application Website will be available uninterrupted and in fully operating condition. We do not accept any responsibility whatsoever for any technical failure, malfunction of or any other problem with any computer network, system, server, provider, telephony system or otherwise which may result in any application or registration not being properly received or set up. We may, at any time, restrict access to users if we deem (at our sole discretion) there to be inappropriate use of the Application Website.

1.5 Information on the Application Website may be inaccurate, incomplete or outdated, and the Application Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or other reasons beyond the reasonable control of Love.    

1.6 Neither Love nor any of its affiliates, officers, employees, agents or other representatives shall be liable for any direct, incidental, consequential, indirect or punitive loss or damages arising out of your use of, or inability to use, the Application Website.

2. Links

The Application Website may contain hyperlinks to Internet websites over which we have no control. We are not responsible for the contents of any linked website (including any goods or services offered or supplied through such website) or any hyperlink contained therein. The inclusion of any link does not imply any endorsement by us of the linked website or any content on such website. Any link within the Application Website that takes you to a third-party website is clicked on entirely at your own risk. 

3. Registration

3.1 You agree to provide true and accurate information about yourself on the Application Website including without limitation all registration details (“Registration Information”).

3.2 At the point of registration you will be asked to supply your first name, last name, an email address and password. You do not have to complete your application in one sitting, but will be able to save it and access it at a later time or date by logging in with your email and password.

3.3 Unless, when completing your application form, you have consented for us to retain your application, we will delete your application within 60 (sixty) days of first transmission of the final episode of the series of programmes for which you have applied.

3.4 You may only have one registration and application subsisting at any one time. Subject to Clause 3.5 below, please do not attempt to create more than one application (e.g. by making multiple applications using different mail or email addresses or making multiple registrations online or using variations of your first or last name). If we have reason to believe that you have applied/ registered, or attempted to apply/ register, more than once in an attempt to create more than one application, we have the right to suspend, terminate or delete your application.

3.5 You cannot amend or change your application once it has been submitted. However, you can at any time request that your application on the Application Website be deleted by sending an email (provided, in the case of an online application, such email is sent by you from the email account with which you made your registration), with subject heading ‘Delete my Application’ to support@take-part.co.uk, giving your full name as it appears on your application on the Application Website. Please note that if your application is deleted prior to the deadline for the receipt of completed applications (“Deadline”), you will not be considered as a potential participant in the Programme unless you make a further application prior to the Deadline, nor you will be able to use the Application Website unless you register again. If any of your personal details (e.g. address, telephone number) change after your application has been submitted, please email us at applyforbakeoff@loveproductions.co.uk.

3.6 When you register, you must provide your real name and any other such details as requested on the registration form. If you provide any information that is untrue, inaccurate or inappropriate or we have reasonable grounds to suspect that such information is untrue, inaccurate or inappropriate, we have the right to suspend, terminate or delete your application.

3.7 You agree not to (i) let anyone else access, create, amend or delete your application, and to notify us if you become aware of any unauthorized access to your application; (ii) access, create, amend or delete someone else’s application.

4. Terms of Service

4.1 All intellectual and other property rights, including trademarks, trade names, domain names and copyright, in the Application Website, and any material or information contained in or downloaded from the Application Website are owned by or licensed to Love or any of its affiliates except where stated as being limited or qualified and are attributed to other parties or persons. No rights of any kind are licensed or assigned or shall otherwise pass to any persons accessing the Application Website. The foregoing does not apply to Material which is the subject of Clause 5 below.

No part of the Application Website may be reproduced, modified, copied, distributed, sold, published or transmitted in any form or by any means without the prior written approval of Love. 

4.2 Under no circumstances may you attempt to auto-download, or mass-download, content from the Application Website. You may not copy, reproduce, republish, download, post, store (including in any other website), distribute, transmit, broadcast, commercially exploit or modify in any way any of the Application Website’s material or content, remove any copyright, trademark or other proprietary rights notices from the Application Website or materials originating from the Application Website, frame or mirror any part of the Application Website without our express prior written consent or permit or assist any third party to do the same. Using software that attempts to connect to the Application Website and copy data is prohibited. You agree that you will not attempt to, or assist any other person to, remove, circumvent or otherwise alter or interfere with our security technology and/or do anything that may damage or impair the Application Website or our services, systems or equipment or those of third parties, including through the use of malicious code, bugs or viruses.

5. Submission of Material as part of Application

5.1 You will retain copyright in any material submitted by you to the Application Website, in whatever form, including without limitation written material, recipes and photographs (“Material”) but we shall be entitled to use the Material in accordance with the Rights granted hereunder without obtaining further permission or making any payment to you. We may remove any Material if we are aware of or are alerted to or suspect a breach of copyright or any other proprietary right(s) without prejudice to any other rights or remedies we may have.

5.2 If you submit any Material to the Application Website, you hereby grant us a royalty-free licence to copy, adapt, edit and reproduce such Material at no charge and in any medium throughout the world in perpetuity for all purposes connected with the selection of contributors to the Programme (including without limitation in order to compile, aggregate and disclose to third parties general demographic information about applications for the Programme), and otherwise to use the Material in accordance with the Take Part Privacy Policy and for such purposes you agree to waive irrevocably all moral rights of whatever nature in the Material. The rights granted by you under this heading are collectively hereinafter referred to as the “Rights”.

5.3 Upon submitting Material to the Application Website you warrant and undertake that the Material you provide:

(i) is genuine and accurate and original to you, is not falsely attributed to someone else, has not been copied or reproduced from any other source, tangible or electronic and does not infringe the copyright or any other right of any third party; and

(ii) is not defamatory, blasphemous or obscene and does not breach any applicable laws or regulations, including but not limited to any contract, duty of confidence or right of privacy.

5.4 You further warrant and undertake that you are fully entitled to submit the Material and grant the Rights to us and have obtained any relevant permissions from third parties.

5.5 We are not obliged to publish, exploit or otherwise utilise any Material submitted by you.

6. Indemnity

We accept no responsibility for your actions or omissions, and you agree to indemnify and hold harmless us, our affiliates, employees, officers, agents and contractors from and against all actions, proceedings, claims, demands and costs (on a full indemnity basis) brought or made against us by any person arising from or in consequence of such actions or omissions, and from and against all damage, loss, cost or expense suffered or incurred by us as a direct or indirect consequence thereof, including in relation to any Material you contribute to the Application Website. You agree that we may notify and/or co-operate with any authorities and law enforcement agencies in relation to any of your activities in connection with our Application Website, including providing any and all information held by us, including your personal or other details, to those authorities and law enforcement agencies.

10. Monitoring

We routinely monitor traffic on the Application Website and suspicious or malicious or excessive activity may be blocked and reported.

We may monitor and record any communications we receive from you. This may be done to improve the services which we provide or to ensure compliance with our practices and procedures.

11. Miscellaneous

11.1 If we decide not to exercise or enforce any of our rights at any particular time, this does not prevent us from later deciding to exercise or enforce that right.

11.2 If any part of these Terms and Conditions is found to be illegal, invalid or otherwise unenforceable by a court or regulator, then, where required, that part shall be deleted and the remaining parts of the Terms and Conditions will continue to be enforceable.

11.3 These Terms and Conditions do not create or infer any rights that are enforceable by any person who is not party to them.

11.4 These Terms and Conditions are exclusively governed by and construed in accordance with the laws of England and will be subject to the exclusive jurisdiction of the English courts.
